The customer, any individual over 18 or legal entity,

Hereinafter "the Customer";

And:

EURL LE NETWORKER, a company with capital of €1, whose registered office is 2, rue des acres, 35133 Parigné, registered with the Rennes Trade and Companies Register under number 830 722 641, represented by Mrs Cassandre Tran.

ARTICLE 1 – PUBLISHER'S ACTIVITIES

The Publisher is a publisher of monthly press distributed in France, Switzerland, Luxembourg, Belgium and Canada, in paper version only.

Within this framework, the Publisher offers subscriptions and packs via its Website that the customer may purchase directly on the Website.

These terms and conditions of sale (hereinafter "the Terms") are issued by EURL LE NETWORKER within the framework of its activity.

 

ARTICLE 2 – ACCEPTANCE OF THE TERMS

We encourage you to carefully read these terms and conditions of sale which we are free to change from time to time. In the event of any change to the terms of sale, the terms applicable to your order shall be those that were on line and that you accepted on the date of placing your order.

Any purchase made on the Website requires your prior acceptance of the terms and conditions of sale in their entirety. By accepting these terms and conditions of sale, you warrant that you have capacity to enter into a contract and particularly that you are not an unemancipated minor or an adult protected by law.

Accordingly, you acknowledge that you may be held liable to us or to third parties in the event that you provide any incorrect, incomplete or false information. 
Should you provide any incorrect, incomplete or false information and insofar as such information significantly impacts the supply of the services available on the Website (input error) or your compliance with your obligations -particularly financial- we may decide to suspend or cancel your subscription with immediate effect and without notice. 

ARTICLE 3 – HOW TO ORDER

You may place an order on the Website 7 days a week and 24 hours a day.
By browsing through the various sections of the Website, you may gradually place the subscription(s) and/or packs selected in your basket by clicking the "buy" button.

By clicking Validate at the end of the ordering process, you expressly confirm that you fully and unconditionally accept these terms and conditions of sale and the prices. You acknowledge being fully aware thereof.

An order will only be permanently validated and the subscription set up once we have received your payment. In the event of payment by cheque, the order will only be validated after receipt of your cheque by the Magazine Le Networker's customer service. Products shall remain the publishing company's property until full payment of the price indicated on the order.

Once your order is accepted, we will send you an order confirmation to the email address you provided.

 

ARTICLE 4 – PRODUCT / OFFER PRICES

The prices of our products and/or subscriptions are indicated in Euro including tax (incl. VAT).

All orders are payable in Euro, wherever they are placed.

The Publisher reserves the right to change its prices from time to time. Products and/or subscriptions shall be charged for based on the rates in force when the order is recorded. The prices applicable to your order are therefore those indicated on the page summarising the content of your basket before you validate your order. These prices are guaranteed unless they are abnormally low, particularly as a result of an error or technical problem. We reserve the right to change them further to an increase in costs, particularly in the VAT rate, and in the event of a misprint or publication error. 

Our offers are valid subject to availability.

The special offer codes and discount codes available may only be used on the Website. The discount will apply to the corresponding offer. The discount or special offer code may only be used once during the validity period of the offer. To use your special offer code, enter the code in the basket page in the "discount code" box.

ARTICLE 5 – DELIVERY

Delivery charges will be added to the price of any order. These charges depend on the subscription and the country of destination. To find out whether the subscription can be sent abroad and the cost thereof, you must indicate a delivery address in the addresses page of your order. If the country in which you wish to receive the magazines included in your subscription is served by the publisher of the selected magazine, delivery charges are calculated automatically and added to the price of the subscription. Otherwise, you will not be able to select the foreign address as the delivery address for your order. In this case, you may contact the customer service to find out the steps you need to take to subscribe. Customs duties or other local taxes or import duties or State taxes may be payable. Such duties and taxes are outside the scope of responsibility of EURL LE NETWORKER and we advise contacting your local authorities for further information in this regard.

Products will be delivered to the delivery address you indicated during the ordering process. The magazines will be delivered to you throughout the term of validity of your subscription, according to their publication frequency.

Delivery is handled by the postal services.

Delivery times may vary from 4 to 8 weeks.

Your delivery address can be changed if you move, by writing to contact@lenetworkermagazine.com. However, the subscription is individual and the subscriber's identity cannot be changed.

 

ARTICLE 6 – TERMS OF PAYMENT

Payments may be made by bank card. Your bank card will be debited at the time of validating your order. EURL LE NETWORKER provides a secure payment service. To pay for your order, you will be asked to provide the bank card holder's name, the bank card number and expiry date and the security code on the back of your card.

Subscriptions for 3, 6 and 12 months are renewed automatically. 

The amount will be debited automatically from the bank card used for the first purchase after 90, 181 or 365 days, depending on the subscription chosen. Subscriptions may be cancelled 14 days before the automatic renewal date:

- By sending an email to contact@lenetworkermagazine.com

- By writing to the registered office: EURL LE NETWORKER MAGAZINE, 2 rue des Acres, 35133 Parigné. 

It will no longer be possible to cancel your subscription less than 14 days before the automatic renewal date. 

ARTICLE 7 – COOLING-OFF PERIOD

Pursuant to Articles L221-18 et seq.of the new French Consumer Code, if you have ordered a subscription to a magazine remotely (online, or by filling in an offer in a magazine) within the meaning of Article L 221-I 1° of the new Consumer Code, or if you have signed an "off premises" contract within the meaning of Article L 221-1-2° of that same code, you have a right of withdrawal permitting you to cancel your order. You may exercise this right by writing to the Publisher within 14 (fourteen) clear days of receiving the first issue of the magazine.

If this period expires on a Saturday, Sunday or public holiday, it is extended to the next first working day. 

Cancellation of an order will entail cancellation of the subscription to the magazine.

In the event of withdrawal within the 14-day period:

·        The subscriber must send the issues they have received back to the Publisher at their own expense, to the address indicated, within 14 days of notifying the Publisher of their intention to withdraw, together with their bank account details.

·        All amounts paid at the time of placing the order will be refunded by bank transfer within thirty days of the date on which the Publisher was informed of the decision to withdraw. The direct costs of returning the magazines received will also be payable by the subscriber.

 

To exercise the right of withdrawal and cancel their order, the subscriber should write to the Customer Service of Le Networker magazine. 

When your subscription is automatically renewed, the cooling-off period no longer applies.

You may cancel your subscription 14 days before the direct debit. 

The 14-day cooling-off period only applies [A1] when you purchase your subscription. 

ARTICLE 8 – LIABILITY

We undertake to comply exclusively with statutory and regulatory provisions applicable in France. No regulations specific to the country in which the Website is viewed may be raised against us.
The Website is accessible 24/7, subject to any closure for maintenance or repair or any force majeure event or event beyond our control. Force majeure is defined by the French courts as any external, unforeseeable and unavoidable event beyond the parties' control, including but not limited to, any regulation, in the broad sense, of a government or supranational authority, a state of war or emergency, a fire or a strike at a supplier's.

You accept the limits of the internet and of electronic communication means. Accordingly, we shall not be liable for any Website unavailability or any connection problem or interruption in the connection when you are visiting the Website or placing an order. We shall not be liable either for any damage of any nature caused as a result. You acknowledge that you are aware of and accept the risks inherent in the functioning of the internet and computer networks and you particularly acknowledge that personal data may be diverted, particularly in countries not providing an adequate level of personal data protection.

 

The photos featured on the website are not a contractual description of the characteristics of the products and/or magazines. The products and/or magazines delivered to you may differ in size, shape and colour from the photos featured on the Website. The publishers shall not, therefore, be liable for any error in any photograph or text.

Elements belonging to us, such as the Website, trademarks, designs, images, texts and logos are the exclusive property of the publishers of the magazines or have been granted to them. 
These terms and conditions of sale do not carry any assignment of any intellectual property right whatsoever in or to the elements belonging to us. You undertake not to directly or indirectly infringe our intellectual property rights.

All texts, comments, reviews, illustrations and images reproduced on the Website are reserved under copyright and under intellectual property for the whole world. Therefore, and in accordance with the provisions of the French Intellectual Property Code, only private use is permitted, subject to the stipulations of the aforementioned Code. Any other use shall be an infringement and is punished under intellectual property law, unless the prior permission of the content publisher is obtained. Any reproduction in whole or in part is strictly forbidden.

ARTICLE 9 – MISCELLANEOUS

Pursuant to the French data protection law of 6 January 1978, you have a permanent right of access, rectification and objection in respect of your personal data. To exercise these rights, you may send a written request by letter or email to our customer service.

We may disclose your last name, first name and address to third parties for commercial purposes. You may object to this disclosure by sending us a letter or email.
